ARABICA — Terms of Use
Welcome to ARABICA ("App", "we", "us", or "our"). ARABICA is an Arabic-language learning application provided by ARABICA ("Company"). These Terms of Use ("Terms") govern your access to and use of the App and all related services. Please read them carefully.
These Terms apply to users in the United States and the United Kingdom. Where applicable, specific provisions address the laws of individual jurisdictions.
1. Acceptance of Terms
By downloading, installing, or using ARABICA, you confirm that you are at least 13 years old (or the minimum digital age of consent in your country if higher), that you have read and understood these Terms, and that you agree to be bound by them together with our Privacy Policy.
If you are under 18 years old (or under the age of majority in your jurisdiction), your parent or legal guardian must review and accept these Terms on your behalf. By using the App, your guardian confirms their acceptance.
If you do not agree with any part of these Terms, you must not use the App.
2. Eligibility & Age Restrictions
2.1 Minimum Age. The App is not directed at children under 13. We do not knowingly collect personal data from children under 13. If you believe a child under 13 has provided us with personal data, please contact us immediately at arabicaapp10@gmail.com.
2.2 Minors (13–17). Users aged 13 to 17 may use the App with parental or guardian consent. In-app purchases require consent from a parent or guardian who accepts financial responsibility.
2.3 UK Users. In the United Kingdom, if you are under 18 you may need a parent or guardian to enter into legally binding agreements on your behalf. The App complies with the UK Children's Code (Age Appropriate Design Code).
3. Account Registration
3.1 You must create an account to access most features. You agree to provide accurate, current, and complete information during registration and to update that information if it changes.
3.2 You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at arabicaapp10@gmail.com if you suspect unauthorised access.
3.3 One person may not maintain more than one free account. Corporate or organisational accounts require written agreement with ARABICA.
3.4 We reserve the right to refuse registration or to cancel accounts at our discretion.
4. Permitted & Prohibited Use
4.1 Permitted Use. You may use ARABICA solely for personal, non-commercial language-learning purposes.
4.2 Prohibited Conduct. You agree NOT to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations;
- Reproduce, distribute, modify, adapt, translate, create derivative works from, or publicly display any content from the App without prior written permission;
- Attempt to reverse-engineer, decompile, disassemble, or circumvent technical protection measures;
- Use automated tools (bots, scrapers, crawlers) to access or extract content;
- Upload or transmit viruses, malware, or any harmful code;
- Impersonate any person or entity or misrepresent your affiliation;
- Interfere with or disrupt the integrity or performance of the App or its infrastructure;
- Harvest or collect other users' data without consent;
- Use the App to send unsolicited communications (spam);
- Engage in any conduct that restricts or inhibits any other user from using or enjoying the App.
5. Intellectual Property
5.1 All content within the App — including but not limited to text, graphics, logos, audio clips, lesson materials, AI avatars, software, and the ARABICA name and mark — is the exclusive property of ARABICA or its licensors and is protected by United States copyright law (17 U.S.C. § 101 et seq.), UK copyright law (Copyright, Designs and Patents Act 1988), and applicable international intellectual property treaties.
5.2 No rights are granted to you other than a limited, revocable, non-exclusive, non-transferable licence to use the App on your personal device(s) for personal, non-commercial purposes.
5.3 If you believe your intellectual property rights have been infringed, please send a notice to arabicaapp10@gmail.com containing: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; and (d) a statement of good faith belief and accuracy.
6. Subscriptions & In-App Purchases
6.1 Pricing. ARABICA offers free and premium subscription tiers. Subscription fees, billing frequency, and included features are displayed within the App before purchase.
6.2 Billing. All purchases are processed exclusively by Apple App Store or Google Play Store, depending on your device. ARABICA does not collect or store your payment card details. Your purchase is governed by the payment processor's terms in addition to these Terms.
6.3 Auto-Renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel auto-renewal at any time through your App Store or Google Play account settings.
6.4 Price Changes. We may change subscription prices. We will give you reasonable advance notice of any price increase before it takes effect. If you do not agree to the new price, you may cancel before the renewal date.
6.5 Free Trials. Where a free trial is offered, you must cancel before the trial ends to avoid being charged. The trial period and conversion price are shown at the time of sign-up.
7. Refunds & Cancellation
7.1 General. Because purchases are processed by Apple or Google, refund requests for App Store purchases must be submitted to Apple (reportaproblem.apple.com), and for Google Play purchases to Google Play support.
7.2 United Kingdom — Consumer Rights. UK consumers have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You have a 14-day cooling-off period from the date of purchase of a digital subscription. If you choose to access the premium content immediately, you expressly request early performance and acknowledge that your right of withdrawal is lost once the content is fully performed or access begins.
7.3 United States. Refunds are subject to the applicable App Store or Google Play refund policy. We will honour refunds required by law in your state.
7.4 Account Cancellation. You may delete your account at any time from within the App (Settings → Delete Account). Deletion does not automatically trigger a subscription refund unless required by law.
8. User-Generated Content
8.1 Licence Grant. If you submit any content to the App — including voice recordings, feedback, or practice submissions ("User Content") — you grant ARABICA a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, and process that content solely to provide and improve the service.
8.2 Representations. You represent that you own or have the necessary rights to submit the User Content and that it does not infringe any third-party rights.
8.3 Restrictions. User Content must not be unlawful, defamatory, hateful, obscene, or otherwise objectionable. ARABICA reserves the right to remove any User Content at its sole discretion.
8.4 Voice Recordings. Voice recordings you submit for pronunciation practice are processed solely to provide feedback. They are not shared publicly and are deleted when no longer required.
9. Third-Party Services
The App integrates third-party services including Google Sign-In, Apple Sign-In, Firebase (Google LLC), and payment processors (Apple App Store and Google Play). Your use of these services is subject to their own terms and privacy policies. ARABICA is not responsible for the practices of these third parties.
Links to external websites or services from within the App are provided for convenience only. We do not endorse and are not responsible for their content or privacy practices.
10. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the App will be uninterrupted, error-free, or secure; (b) any defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results obtained from using the App will be accurate or reliable.
United Kingdom: Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015 that digital content must be of satisfactory quality, fit for purpose, and as described.
11. Limitation of Liability
11.1 To the maximum extent permitted by applicable law, ARABICA and its affiliates, officers, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of profits, data, or goodwill) arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages.
11.2 Our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of: (a) the amount you paid to ARABICA in the twelve months preceding the claim; or (b) USD $50 / GBP £40.
11.3 United Kingdom. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
12. Indemnification
You agree to indemnify, defend, and hold harmless ARABICA and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the App; (c) your User Content; or (d) your violation of any third-party right.
13. Termination & Suspension
13.1 By You. You may stop using the App and delete your account at any time.
13.2 By ARABICA. We may suspend or terminate your access immediately, without prior notice, if we reasonably believe you have violated these Terms, applicable law, or if we determine it is necessary to protect ARABICA, other users, or third parties.
13.3 Effect of Termination. Upon termination, your licence to use the App ceases. Sections 5, 10, 11, 12, 14, and 16 survive termination.
14. Dispute Resolution
14.1 United States — Binding Arbitration. If you are a US resident, any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and ARABICA waive the right to a jury trial and to participate in any class action or representative proceeding. This arbitration clause does not apply to claims that qualify for small claims court.
14.2 United Kingdom. If you are a UK resident, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that you may also bring proceedings in any court of your country of residence. Nothing in these Terms affects your right to use UK alternative dispute resolution (ADR) schemes.
14.3 Informal Resolution. Before initiating any formal proceeding, you agree to contact us at arabicaapp10@gmail.com and give us 30 days to attempt to resolve the dispute informally.
15. Governing Law
These Terms shall be governed by and construed in accordance with:
- For US residents: the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions.
- For UK residents: the laws of England and Wales.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or by emailing you at the address associated with your account at least 14 days before the change takes effect (30 days for material changes affecting UK consumers).
Your continued use of the App after the effective date of revised Terms constitutes your acceptance. If you do not agree, you must stop using the App before the effective date.
17. Force Majeure
ARABICA shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, or internet service disruptions.
18. Severability & Waiver
If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
19. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features of the App, constitute the entire agreement between you and ARABICA regarding the App and supersede all prior agreements.
